Johnson & Johnson Agrees to Pay $420 Million in ASR Implant Cases
ASR hip implant devices produced by DePuy Orthopedics, a subsidiary of Johnson & Johnson, have been recalled since 2010.
Upon discovering that 12 percent of the devices failed within the first five years, more than 93,000 ASR implants were recalled worldwide. The implants were found to contain a corrosive metal that would bleed into the hip tissue and bones of patients.
The corrosive metal caused a dangerous disease called mellatosis. Patients with the defective implants were forced to undergo extensive surgery to remove the implant. After an initial wave of lawsuits after the recall, Johnson & Johnson settled the defective ASR implant cases in 2013 for $2.5 billion.
Under the terms of the 2013 settlement, only patients whose implant devices were removed by the end of 2013 were allowed to recover. Facing ongoing litigation on the ASR hip implant devices from patients whose devices were removed after 2013, the company has recently announced a new and additional settlement.
According to an article by Bloomberg News, Johnson & Johnson has agreed to extend the ASR defective hip implant claims deadline. Under the terms of the new settlement, patients who received follow-up surgery after 2013 but on or before Jan. 31, 2015, will be entitled to a base payment of $300,000 per person. Additional compensation will be available to patients who were excessively harmed by the defective devices.
When the final tally is calculated, the defective ASR hip implant devices will cost Johnson & Johnson more than $4 billion.
