Fatal Car Accidents in Missouri

Concordia, MO – Firefighter Killed in Car Crash on Route E near MO-23Each year, hundreds of people die as a result of automobile accidents across the state of Missouri. Many accidents are a result of drivers who engage in reckless and negative actions. Drivers who are speeding, failed to yield to others, or engage in other reckless actions continue to cause fatal injuries to innocent people every day in our state. In many cases, these accidents leave families to deal with overwhelming consequences.

After a loved one dies in a car accident, the last thing you want to think about is filing a lawsuit. But if the accident was caused by someone else’s negligence, you may have no choice but to take legal action.

Missouri law allows certain family members to file a wrongful death action against the person or persons responsible for the death. This type of lawsuit can’t bring back your loved one, but it can help ease the financial burden caused by their death.

The statute of limitations in Missouri for filing a wrongful death case against the negligent driver is two years from the date of the deceased’s death. This means that you must file your lawsuit within two years of your loved one’s passing in order to be eligible to receive damages. If you do not file within this timeframe, you will likely be barred from recovering any compensation.

To file a wrongful death action in Missouri, you must be the surviving spouse, child, or parent of the deceased person. You will also need to show that the death was caused by someone else’s negligence or intentional act. A Concordia wrongful death lawyer can help your family move forward and file legal action following the loss of your loved one.
