Under most circumstances, a wrongful death claim may only be brought by the surviving parent/guardian, spouse, or child of the decedent and, in the best-case scenario, the claimant will be awarded financial compensation for their damages.

Wrongful death actions can be brought against someone for numerous reasons. Provided that the deceased was killed because of negligence or a deliberate criminal act, almost all courts will try a wrongful death case. Wrongful death suits are frequently filed after deaths that are the result of car accidents, defective products, medical malpractice, workplace accidents, and criminal activity.

Even if the defendant has been found not guilty in criminal court, they could still be held economically accountable in a civil court should the deceased’s family decide to bring a claim of wrongful death. This is due to the fact that the burden of proof is much lighter in civil court because the jury can only grant financial compensation. They can’t impose criminal charges.
