Categorized as Auto Accidents

Platte Township, MO (December 05, 2020) – A two-vehicle collision resulted in injuries to the drivers of both cars as well as a 10-year-old girl on Saturday, December 5th at about 5:55 p.m. on 23 Highway in Platte Township.

According to police reports, a southbound 2019 Ford slowed to a stop in the roadway as it waited to make a turn near Southeast State Route DD when it was rear-ended by a 2010 Toyota.

The occupants of the rear-ended Ford, a 50-year-old male, and a 10-year-old female, both residents of Nixa, were both transported by Johnson County Ambulance District to Western Missouri Medical Center. Their injuries were classified as non-life-threatening.

The driver of the Toyota, a 25-year-old male from Knob Noster, was also transported with non-life-threatening injuries.

Our thoughts are with the injured victim and their family at this time. We hope for their full recovery.

Rear-End Collisions in Platte Township

The general rule concerning rear-end collisions in Missouri is that the striking driver will be held accountable for the accident. When filing a claim, the plaintiff is allowed to put into effect the state’s rear-end collision doctrine.

As outlined in the doctrine, the claimant will be expected to establish three elements. First, that they were lawfully on the road. In other words, they had a valid license and registered vehicle. Secondly, they were struck from behind by the offender’s car, and third, that they did not behave negligently.

These components are usually simple to prove and, once this accomplished, the burden of proof of non-negligence is now on the offending driver.
