Rear-End Collisions in Platte County
The default rule regarding rear-end accidents in Missouri is that if you rear-end another vehicle, you will be considered liable for the crash. When filing a lawsuit, the claimant is able to invoke Missouri’s “rear-end collision doctrine.”
According to the doctrine, the claimant will be required to prove three things. First, that they had a right to be on the roadway, meaning they had a valid driver’s license and a properly licensed vehicle. Second, that they were hit from behind by the defendant’s vehicle, and third, that they were not in any way negligent.
These three elements of a rear-end collision are easy for the claimant to establish. Once they do so, however, the burden of proof is placed on the defendant and it is now up to prove they were not negligent.
