Injury Accident in Spokane
For those involved in a traffic accident, one of the most important issues that need to be addressed is who was at fault, legally referred to as liability.
Liability is a legal concept that is based on the duty of care that motorists are obligated to show others on the roadway. According to Missouri law, the operator of any motor vehicle owes other drivers, their passengers, and other people near or on the road, a statutory duty to exhibit the greatest possible amount of care. In this regard, Missouri is quite singular as just about every other state only states that drivers are to exhibit a degree of care similar to what a reasonable person would exhibit in an identical or comparable situation. This is called the “reasonable person standard.”
So, following a car accident in Missouri, the real question at hand is actually “Which driver failed to exhibit the greatest degree of care?” Ultimately, the trier of fact may determine that no one was liable, just one driver was liable, or that both drivers were liable, in which case state law allows fault to be distributed between the drivers by assessing percentages of liability.
Victims involved in accidents are often forced out of work for several weeks at a time, going without the monetary support they need to pay their bills and take care of their families. To make the struggle even worse, towering medical bills start rolling in immediately.
