In right-of-way accidents, there are usually conflicting accounts of what happened because each driver believes that their decision was the right one. Luckily, Missouri follows comparative fault insurance laws. In other words, a driver who is injured during a crash might still be eligible to receive financial compensation even if they share some of the fault.
Missouri allows blame to be established in several different ways, through things such as eyewitness accounts, discovery via opposing council, and the testimony of expert witnesses. Although the state affords you a very generous five-year statute of limitations in which to file your claim, it is imperative that you speak with a personal injury attorney as soon as possible. The longer you wait, the harder it will be to prove your version of events and obtain full and fair financial compensation.
The driving law that is most often disregarded according to Missouri vehicle collision data is cell phone use or the use of some other electronic device on the part of the driver. A little more than 14% of all car crashes across the state are the result of a driver’s misdirected attention.
