Serious Car Accidents in Kansas City
It is not unusual for collisions based on who had the right-of-way to be a point of contention between the drivers. After all, they involve two drivers both believing they had the right-of-way and the other driver is at fault for the accident.
In accidents like this, statements of what happened are usually at odds because both drivers feel that their decision was the right one. Luckily, Missouri follows comparative fault insurance laws. This means that a driver who is hurt during an accident could still be entitled to collect financial compensation even if they share some fault.
Currently, the state of Missouri allows driver fault to be determined in multiple ways, including things like eyewitness descriptions, discovery through opposing councils, and the testimony of expert witnesses. Even though the state gives plaintiffs a very lengthy five-year statute of limitations in which to file their claim, it is imperative that you speak with a personal injury attorney as soon as possible. The longer you wait, the harder it will be to prove your version of events and obtain full and fair financial compensation.
