Car Accidents in Platte County
Following a car crash, one of the foremost worries that everyone has is which driver was at fault, also referred to as liability.
Liability is based on the duty that vehicle operators owe to others on or near the roadway. According to Missouri law, drivers owe each other, passengers in their vehicle, and other people on or around the roadway, a legal responsibility to show the highest possible standard of care. In this sense, Missouri is different from other states since most others only require drivers to show a degree of care that is comparable to what a reasonable person would have demonstrated in a similar situation. This is usually referred to as the reasonable person standard.
So, following a Missouri car crash, the question that most needs to be answered is which driver failed to show the greatest standard of care? Ultimately, the trier of fact may conclude that neither of the drivers was liable, one driver was liable, or that both drivers were liable, in which case state law allows liability to be allocated between the drivers by determining percentages of liability.
