Wrongful Deaths in Saline County
A successful wrongful death claim demands more than a sympathetic attorney. To get the full amount of financial compensation your family is entitled to, you will need a strong legal advocate in your corner with the right knowledge, skill, and experience.
Missouri law is very specific about who is able to file a claim for wrongful death. Priority is given to the victim’s closest relatives and, from there, works its way down the family tree. This means preference is given to the victim’s surviving children and spouse. Following them would be a surviving grandchild if they have one.
If neither of those parties file, then the surviving parents may do so. If the victim was a child, however, parents are obviously given priority.
While filing a lawsuit might not occur to you immediately after tragedy strikes your family, it is important that you understand the value of a legal claim. Even more important is being familiar with the deadlines connected to filing a claim of wrongful death.
State law provides three short years from the date of the death for your family to file a suit for wrongful death. Failure to meet this deadline will likely result in the forfeiture of your claim.
