Fatal Car Accidents in Missouri
A fatal car accident can impact your family forever. Losing a loved one suddenly and unexpectedly is not something that people are able to prepare for. Unfortunately, hundreds of people die as a result of traffic accidents that take place in the state of Missouri every year.
In many cases, families end up losing loved ones as a result of driver’s negligence. If your loved one died due to someone else’s negligence, you may be able to file a wrongful death lawsuit. Wrongful death lawsuits are designed to help the surviving family members recover damages such as funeral expenses, lost earning capacity, and loss of parental guidance.
No amount of money can ever truly compensate you for the loss of a loved one. However, filing a wrongful death lawsuit can help ensure that you receive some financial compensation for your losses. This can help make sure that you don’t have to bear the full financial burden of your loved one’s death.
Most wrongful death lawsuits are based on negligence. This means that the death was caused by someone who failed to act with reasonable care. For example, if a drunk driver crashed into your loved one’s car, causing their death, the driver may be considered negligent.
In order to succeed in a negligence-based wrongful death lawsuit, you will need to prove that the defendant was required to provide your loved one the duty of care and that they breached this duty. You will also need to show that this breach of duty resulted in your loved one’s death and that you have suffered damages as a result.
If you are considering filing a wrongful death lawsuit, it is important to speak with a wrongful death lawyer in Jefferson who can evaluate your case and help you understand your legal options.
