Fatal Car Accidents in Missouri
More than 1,100 people were fatally hurt in crashes that occurred in the state of Missouri in 2021. The number of fatalities reported continues to increase year after year. Unfortunately, accidents that claim the lives of innocent people are often preventable. We see many acts of negligence contribute to fatal crashes across our state, including:
- Drivers who are intoxicated.
- Drivers who are distracted by their phones in other objects.
- Drivers who are speeding or traveling too fast for road conditions.
- Drivers who fail to yield to other motorists.
- Drivers who pass through stop signs or run red lights at intersections.
- Drivers who engage in negligent actions.
- Road rage accidents.
When innocent people die as a result of these and other preventable causes, families are often able to pursue legal action against the driver who is at fault. Missouri law allows certain family members to recover damages for the death of a loved one caused by the negligence of another.
To file a wrongful death claim in Missouri, the following elements must be met:
- The death was caused by the negligence or recklessness of another person or entity.
- The decedent’s surviving spouse, child, or parent suffered monetary damages as a result of the decedent’s death.
- A personal representative has been appointed for the decedent’s estate.
If these elements are met, the surviving spouse, child, or parent may file a wrongful death lawsuit to recover damages, including:
- Funeral and burial expenses
- Medical expenses related to the decedent’s final injury or illness
- Loss of earnings and benefits
- Loss of companionship and love
- Pain and suffering
