Car Accidents in Missouri

Callaway, MO – Lorenzo Davis Hurt in Auto Wreck on US-54 near Route JMotor vehicle wrecks often have devastating consequences for those involved. Unfortunately, innocent people are harmed every single day as a result of crashes that take place here in Missouri. The majority of accidents occur as a result of negligent motorists. This can include drivers who are impaired, distracted, or failed to yield to others.

When innocent people are harmed as a result of negligence, they can file personal injury cases against those who are responsible. In order to prove negligence, the claimant must show that the defendant failed to use reasonable care and that this failure was the cause of the plaintiff’s injuries.

There are many factors that can be considered when determining whether or not a driver was negligent. Some of these factors include:

  • The speed of the vehicle
  • The weather conditions at the time of the accident
  • The condition of the roadway
  • The visibility at the time of the accident
  • Whether or not there were any witnesses to the accident
  • If there was any damage to the vehicles involved in the accident
  • The statements of the drivers and passengers involved in the accident
  • The police report of the accident

Missouri is an at-fault state, which means that a driver who causes an accident is responsible for paying for any damages that result from that accident. In some cases, both drivers may be found to be at fault for an accident. For example, if one driver ran a red light and another driver was speeding, they may both be found at fault for causing the accident.
