Car Accidents in Missouri
After meeting her in a motor vehicle accident, you may be able to file a personal injury case against the driver who is at fault. There are a few different factors that can play into who is at fault in a car accident. If one driver rear-ends another, then that driver is typically at fault. If a driver runs a red light or stop sign, they will likely be held at fault. If a driver is speeding and causes an accident, they may also be held responsible.
In general, the driver who caused the accident will be held liable for any damages that occur as a result. This means that if you are involved in an accident where you are not at fault, you may be able to seek compensation from the other driver’s insurance company. It’s important to note, however, that insurance companies will often try to minimize their payout, so it’s important to have an experienced car accident lawyer on your side. One of the ways that they try to minimize the amount of compensation that you recover is by shifting the fault of the accident on to you.
In Missouri, the courts follow the rule of pure comparative negligence when determining how to pay damages in a car accident case. This rule provides that each party is responsible for the amount of damages equal to their percentage of fault for the accident. For example, if you are found to be 20% at fault for an accident, you would be responsible for 20% of the total damages incurred by the other parties.
This rule can have a significant impact on how much money you may receive for damages you’ve suffered as a result of an accident. It is important to speak with an experienced car accident attorney in Houston who can help you understand your rights and options under the law.
