Car Accidents in Missouri

Salisbury, MO – Four Juveniles Injured in Auto Wreck on US-24It is important to note that Missouri has a “comparative fault” law, which means that even if you are partially at fault for causing an accident, you may still be able to recover damages from the other party. However, your award will be reduced by your percentage of fault. For example, if you are 20% at fault for causing an accident, you will only be able to recover 80% of your damages from the other party.

To prove that another person is at fault for an accident, you must be able to demonstrate that he or she:

  • Owed a duty of care to you
  • Breached their duty of care by acting negligently
  • Their actions directly caused your injuries

It is important to know that there are several types of negligence. The type of negligence involved in your accident may affect the amount of damages you can recover and will require specific evidence to prove. The insurance company representing the at-fault driver may try to claim that your actions were negligent, so it is important to seek experienced legal counsel as soon as possible after an accident to protect your rights.

If you have been involved in an accident in which both parties may be at fault, it is important to speak with a Salisbury car accident attorney who can help you understand your rights and options moving forward.
