Fatal Dog Attacks in Missouri
In 2009, the state of Missouri got rid of its “one bite” dog law. Instead, they now operate on a strict liability basis when it comes to animal attacks. This means that if a dog attacks and kills someone, the owner is automatically liable, regardless of whether or not the dog has ever bitten anyone before.
Families who have lost a loved one to a fatal dog attack can recover damages for their loss by pursuing legal action against the owner of the dog. In Missouri, families are entitled to compensation for various losses they face. These include compensation for:
- Lost earnings capacity: This is the loss of future earnings and earning capacity that the deceased would have earned had they not died prematurely.
- Pain and suffering: The survivors may recover damages for the pain and suffering endured by the deceased prior to their death.
- Loss of parental guidance: If the deceased was a parent, the surviving children may recover damages for the loss of guidance and support that they would have received from their parents.
- Loss of companionship: The surviving spouse or partner may recover damages for the loss of companionship and society that they have suffered as a result of the death of their loved one.
- Wrongful death damages: In addition to the aforementioned damages, families are also able to seek compensation to cover funeral expenses, burial fees, and more.
