Car Accidents in Carthage
After being in a car accident, one of the main concerns on everyone’s mind is which driver was at fault, legally referred to as liability.
Liability hinges on the duty that drivers owe to other people on the road. Missouri law states that the drivers of motor vehicles owe one another, their passengers, and other persons on or near the roadway, a legal obligation to demonstrate the highest standard of care. In this respect, Missouri is unique as almost every other state only requires drivers to demonstrate a level of care comparable to what a reasonable driver would have shown in a similar or identical situation. This is commonly known as the “reasonable person standard.”
So, after a Missouri car accident, the prudent question is really which driver neglected to demonstrate the highest standard of care? In the end, the trier of fact could conclude that neither driver was at fault, one driver was at fault, or both drivers were at fault, in which case Missouri law permits liability to be apportioned among the drivers by calculating percentages of liability.
