Stewartsville MO - One Injured in Two-Car Crash on US-36
Stewartsville, MO (January 11, 2021) - One driver was injured when another driver failed to yield the right-of-way at the intersection of State Route 31 and US Route 36 in Washington Township on Saturday, January 9th.
Police reports show that the accident happened at about 5:35 p.m.when the driver of a 2009 Ford Focus heading southbound on State Route 31 came to a stop at the intersection of US Route 36.
The Ford then attempted to proceed through the intersection instead of yielding the right-of-way to the westbound 2018 Kia Sorento coming down US Route 36. The Kia struck the driver’s side of the Ford and both vehicles ended up in the median.
The driver of the Kia, a 37-year-old man from Stewartsville, was transported by Dekalb County Ambulance to Mosaic Life Care in St. Joseph for treatment of injuries classified as non-life-threatening.
The condition of the man driving the Ford has not been reported.
Our thoughts are with the injured victim and their family at this time. We hope for their full recovery.
Right-of-Way Accidents in Stewartsville
It is not uncommon for accidents centering around who had the right-of-way to be the source of a rage-fueled altercation between the drivers. After all, they involve two people both insisting that they had the right-of-way and the other driver is to blame for the crash.
In accidents like these, accounts of what happened are often ambiguous because both drivers believe that their choice was the correct one. Luckily, Missouri follows comparative fault insurance laws. In other words, a driver who is injured during a crash might still be eligible to receive financial compensation even if they share some of the fault.
Missouri allows blame to be established in several different ways, through things such as eyewitness accounts, discovery via opposing council, and the testimony of expert witnesses. Although the state affords you a very generous five-year statute of limitations in which to file your claim, it is imperative that you speak with a personal injury attorney as soon as possible. The longer you wait, the harder it will be to prove your version of events and obtain full and fair financial compensation.
Victims involved in accidents are often forced out of work for several weeks at a time, going without the monetary support they need to pay their bills and take care of their families. To make the struggle even worse, towering medical bills start rolling in immediately. When victims are harmed in accidents as a result of other motorists, our state allows them to file legal claims against wrongdoers to recover compensation for the financial burdens they endure. Victims can benefit immensely by consulting with a car accident attorney in Missouri who is well-versed in personal injury laws in our state.
