In right-of-way accidents, there are normally opposing accounts of what happened because each driver thinks their decision was the right one. Luckily, Missouri observes comparative fault insurance laws. This means that a driver who is injured during a crash could still be eligible to receive financial compensation even if they share some of the blame.
Missouri allows liability to be assigned in a few different ways, through things such as eyewitness accounts, discovery via opposing council, and the testimony of expert witnesses. Although the state allows a very generous five-year statute of limitations in which to file your claim, it is important to speak with a personal injury attorney as soon as possible. The longer you wait, the harder it will be to prove your version of events and obtain full and fair financial compensation.
