Helping Missouri Residents Secure the SSD Benefits They Deserve

Social Security issues can be very complex. Claimants can be denied benefits regardless of how legitimate their claim may be. If you have been denied benefits through Social Security, filing an appeal is time sensitive—you have only 60 days to do so.

At Peterson & Associates, P.C. our Kansas City Social Security disability attorneys and representatives handle SSDI and Supplemental Security Income (SSI) claims and appeals for individuals throughout the entire United States. Allow us to work for you in obtaining the benefits you deserve.

How We Can Help You

One of the biggest complaints about the Social Security disability application process is that it takes too long. We can help you submit a more complete and thorough application, which can lead to a faster award of the Social Security Benefits to which you are entitled. We will work hand-in-hand with you to carefully consider whether your case qualifies for an “on the record decision.”

Peterson & Associates, P.C. represents individuals at all of the following levels:

  1. Initial Application Filing for Benefits
  2. Appeal and File Request for Reconsideration - if applicable
  3. Appeal and File Request for Hearing
  4. Appeal and Request Review by the Appeals Council.

How the SSD Application Process Works

Your application is submitted to a local Disability Determination Services (DDS) office to be reviewed. You will receive written notice from Social Security once your claim has been decided.

If your initial application is denied, you must file an appeal within 60 days or you will lose your right to appeal and your latest decision will become final. However, you have every right to challenge an adverse determination, and our Kansas City SSD lawyers are here to help you.

What Happens If My Application Is Rejected?

Many initial applications are likely to be denied at first.

Some rejections are due to minor documentation issues or other areas that have not been addressed. In fact, many applicants that are rejected on the first attempt may still be awarded benefits after appeal.

Listed below are some of the steps involved once an initial claim has been denied:

  1. Request for Reconsideration - if applicable: Reconsideration reviews all the original evidence used to make the initial decision, plus any additional evidence which may be provided. Almost every reconsideration is another denial and requires the next step.
  2. Request for Hearing: Statistically, the hearing level is your greatest opportunity for success. This process includes requesting a hearing before an Administrative Law Judge (ALJ).
  3. Request Review by the Appeals Council: The Appeals Council reviews hearing decisions made by an Administrate Law Judge (ALJ). This review could lead to:
    • An affirmation of the ALJ’s decision; or
    • A reversal of the ALJ’s decision; or
    • The case be sent to a different ALJ for review.
